Terms and Conditions

These Subscription Terms and Conditions ("Terms") govern the use of the subscription services offered by MapTalesGo through its mobile tourist audio guide application ("the App"). By subscribing, the user ("you") expressly accepts these Terms. If you do not agree with any of them, you should not purchase the subscription or use the App in subscription mode.

1.Introduction and Acceptance

These Terms apply to the use of subscription services offered through the app.

2.Service Description

A subscription to MapTalesGo grants unlimited access, during the contracted period, to all audio guides available for the city included in the active subscription.

As of the publication date of these Terms, the available subscriptions include exclusive content for the city selected at the time of purchase. Currently, subscriptions are available for the cities of Paris and London. Paris contains at least 110 audio stories distributed as follows:

• 42 historical buildings
• 27 historical figures
• 15 historical events
• 15 myths or legends
• 11 festivities

MapTalesGo may add new cities, including Rome and Madrid, and may offer subscriptions that include more than one city.

Content can be downloaded to the device for offline listening. However, if the App is uninstalled, downloaded audio files will be deleted and must be downloaded again after reinstallation, provided the subscription remains active.

3.Subscription Types and Prices

MapTalesGo currently offers the following auto-renewable subscription options for the city of Paris:

• Weekly subscription
• Monthly subscription
• Annual subscription (includes Family Sharing via Apple's Family Sharing feature)

MapTalesGo may also offer subscription plans for other cities or bundled plans that include more than one city, with details shown in the App Store prior to purchase.

Pricing. Prices are set by MapTalesGo in App Store Connect and are displayed in the local currency of your App Store region. The final amount may vary depending on your country or region, applicable taxes, and Apple's regional pricing policies.

4.Free Trial Period and Demonstration Content

Before purchasing any subscription, the App offers 8 free audio guides as demonstration content:

• 4 historical buildings
• 2 famous figures
• 1 festivity
• 1 historical event

This free content allows the user to evaluate the quality and functionality of the service before making a purchase. The user acknowledges that, once subscribed, they cannot claim ignorance of the content or its operation as grounds for a refund.

5.Billing, Automatic Renewal, and Cancellation

• The subscription is charged to the Apple ID account used at the time of purchase, at the time of confirmation.
• The subscription automatically renews at the end of each contracted period unless the user cancels at least 24 hours before the renewal date.
• The user can manage or cancel the subscription from Settings > Apple ID > Subscriptions on their device.
• Upon canceling the subscription, the user will retain access to the content until the end of the period already paid for.

6.Refund Policy

• All payments and refund requests are handled exclusively through Apple and are subject to the App Store's terms and conditions.
• MapTalesGo does not process or approve refunds directly.
• Since the App provides free content prior to subscription and all available content can be consumed in less than 8 hours, no refunds will be issued for dissatisfaction once the subscription period has started, except in cases provided for by applicable law and Apple's refund policy.
• Users who consume all content in a short period and request a refund may have their request denied in accordance with these Terms and Apple's policies.

7.Permitted Use and Restrictions

The subscription to MapTalesGo is granted solely for personal and non-commercial use. The following is strictly prohibited:

• Copying, distributing, or sharing audio guides outside the App.
• Using the App or content for commercial, broadcast, or resale purposes.
• Tampering with the App to circumvent technical limitations on downloading or accessing content.

Failure to comply with these restrictions may result in immediate suspension or termination of the subscription without the right to a refund.

8.Revocation of Access for Misuse

MapTalesGo reserves the right to suspend or terminate access to the subscription without prior notice and without the right to a refund if abusive use of the service is detected. Abusive use includes, but is not limited to:

• Massive and repetitive downloads of content in short periods that exceed the normal use of an individual user.
• Successive reinstalls of the App solely to repeatedly download all content.
• Actions that generate disproportionate resource consumption or excessive costs on our storage servers (Firebase Storage).

If such behavior is detected, MapTalesGo may revoke access to the content and block the user's account or anonymous identifier.

9.Service Availability

MapTalesGo makes every effort to ensure that the App and its content are continuously available. However, uninterrupted availability of the service is not guaranteed, especially in cases of scheduled technical maintenance, failures of third-party providers, or force majeure.

The user acknowledges that they are not entitled to compensation or a refund for temporary service interruptions, provided these are not due to gross negligence or willful misconduct by MapTalesGo.

10.Changes to Prices and Terms

MapTalesGo reserves the right to modify subscription prices, features, and included cities at any time. This includes adding new cities, changing included content, or creating combined subscription plans.

Any change in the subscription price will be notified in advance through the App Store and will apply in the next billing period. Continued use of the subscription after the changes take effect will constitute acceptance of the new terms.

11.Limitation of Liability

The App and its content are provided "as is" and "as available." MapTalesGo does not guarantee that the App will be free of errors, interruptions, or defects, nor that the content will meet the user's subjective expectations.

• MapTalesGo will not be liable for data loss or temporary service interruptions.
• MapTalesGo will not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the App.

This limitation does not affect legal rights that cannot be excluded under applicable law.

12.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the country or territory from which MapTalesGo manages its operations at any given time. If the user resides in a European Union country, the applicable consumer protection and e-commerce regulations of that territory shall also apply.

13.Severability

If any provision of these Terms is found invalid or unenforceable by a competent court, that provision shall be limited or eliminated to the minimum extent necessary, without affecting the validity and enforceability of the remaining provisions.
